Terms of use and disclaimer

This website is owned and published by Captain Consumer Limited, a limited company registered in England and Wales ("the Company").

Use of this and/or of any other website that is owned and published by the Company and that refers users to these terms ("the Site") is subject to the following terms and conditions, which by using or attempting to use the Site all individuals and organisations are deemed to accept:

The Site is provided as a free service and use of it or of any of its constituent elements does not create any legal relations between the user and the company other than as specified below.

Information contained on the Site in relation to any other organisations or sites may not have been independently verified by the company. Neither the company nor any of its directors, officers or employees give any representation or warranty as to the accuracy, veracity, completeness and/or reliability of any content of the Site or emails from the Site, nor as to any information contained on any website which is accessed via the Site or via any emails sent from the Site (the definition of which includes emails sent from an email address at captainconsumer.com on behalf of the Site), nor as to the fitness of the Site or emails sent from the Site for any particular purpose.

The Company does not necessarily have any relationships, commercial or otherwise, with sites to which links exist on the Site. You are advised to verify the accuracy of any information obtained from or via the Site or from emails sent from the Site before relying on it. In no circumstances shall the Company or any of its directors, officers or employees be liable for any loss or damage suffered as a result of any use or attempted use of the Site or of any emails received from the Site.

Images and content on the Site and emails from the Site are protected by copyright and may not be reproduced or appropriated in any matter without first obtaining the written permission of their respective owner(s). Users agree that by posting in the Site's forums, reviews or blogs or by emailing the site they are transferring to the Company all intellectual property rights relating to the content of such posts or messages. The phrases "captain consumer", "shop, save, rant & rave" and further names and phrases as stated on each Site are Trade Marks of the Company. Use of the Company's Trade Marks or of substantively similar names or phrases including registering them as domain names is prohibited by law. Other Trade Marks referred to on the Site are acknowledged as belonging to their respective owner(s).

Reproduction of the Site or the content of any emails sent from the Site in whole or in part and in any form or medium without express written permission from the Company is prohibited.

Whilst the Company takes every care to ensure that the standard of the Site remains high and to maintain the continuity of it, the internet is not an inherently stable medium, and errors, omissions, interruptions of service and delays may occur at any time. The Company does not accept any ongoing obligation or responsibility to operate the site (or any particular part of it) or to provide the service offered on the Site.

It is the responsibility of users to keep checking the Site's terms of use and disclaimer, which may be amended by the Company from time to time without notice.

The Company takes your online privacy seriously. You may visit the Site anonymously as often as you like without providing any personally identifying information (such as your name, address or e-mail address). We do not collect personally identifying information from you except when you specifically provide it and we seek to protect all the information we receive. If you ask to be added to a newsletter, forum or other subscription list, we may use cookies in order to be able to provide those services. We may also use cookies to identify your browser so that it can provide the best link to this site. Our site may contain adverts served by third-party companies (eg Google) that use Cookies to gather information (not including your name, address, email address or telephone number) about visits you've made to the Site and elsewhere online in order to generate adverts for products and services that may be more relevant or of more interest to you. For more details regarding interest based advertising and how to opt out from it click here. We never share your e-mail address with third parties except, in rare instances, as may be required by law, to protect our site or to enforce compliance with our Terms of use and disclaimer. Please read below for a further explanation of what information the Company gathers and how it is used.

Broadband, TV, phone and mobile phone price comparisons on websites goverened by this privacy policy are provided by Decision Technologies Limited (“Decision Tech”). If you click on any broadband, TV, phone or mobile offers provided by Decision Tech on any of our websites, then Decision Tech will collect your computer’s IP address and use it to track the offer you have selected and to monitor and improve the performance of their service. Decision Tech will be a data controller in relation to this personal data and its use will be subject to the terms of their own privacy policy. Please note, if you place an order for a broadband, TV, phone or mobile offer with a supplier (for example, BT, EE, or Sky), you will be entering a contract directly with that supplier and we advise you to carefully read their privacy policy and their terms and conditions.

Information You Provide

As you use the Site, you may find places where we ask you to provide us voluntarily with information about yourself.

In some cases, we may request only your e-mail address so that we can send you the specific information you request (eg an email newsletter subscription). If you provide us with your email address and later decide that you do not want us to have it, please follow the unsubscribe instructions that are contained in the subscription confirmation email message that you received from us.

In other cases, such as a competition or prize draw, we may request your e-mail address, name (along with your contest answer) and physical address so that we can deliver a prize in the event that you win.

Any email that you send to the Company directly will include your email address and possibly also your name in the "from" line. We will use information we receive in this manner only for the purpose of responding to your communication and will not send you unsolicited offers, add you to any mailing lists or pass your details to anyone else.

The Site may feature sections where you can submit comments, opinions or suggestions using online methods such as forum posts, blog comments or consumer reviews - parts of the Site where you can participate in discussions on particular subjects by posting written comments which are then made available for other registered users and/or all Site visitors to view. Such facilities may also enable you to send private messages to other users. Registration for and use of these facilities may involve us asking for your name, email address and other optional items of information. We ask for your name so that other people reading your comments will be able to determine which comments come from which people. You may provide a nickname or alias if you prefer so that your identity is not disclosed. You will also usually have the option of concealing your email address from public view (often within "profile" or "options" settings). Any personal information that you do voluntarily disclose on a forum or elsewhere may be seen, collected and used by others and may result in unsolicited messages from other people or companies.

Whether or not you choose to participate anonymously, you are still legally liable for the content of any material that you submit via the Site including for claims of libel, invasion of privacy and copyright infringement and by using the Site you agree to indemnify the Company from any claim made against it in respect of any content that you place or cause to be placed on the Site and you also agree to reimburse the Company for any and all direct and indirect costs it may occur in dealing with any such claims. Relevant sections of the Site may contain additional rules applying to their use.

Your participation in all activities that involve disclosing such information is purely voluntary; if you do not wish to reveal your details you may simply ignore these offers. If you do participate, we will not use your details for any purpose other than as stated and will not give, sell or rent your details to any third parties.

Cookies and IP addresses

Cookies are unique bits of code that most major web sites place on your computer when sending you a web page. This is standard practice on the Internet. The Company uses these and also keeps records of the IP addresses of users that have visted its Sites. These tools identify your computer's browser and operating system, which helps us to optimise site design and improve your user experience. We also use cookies to manage access to certain sections of the Site (eg to enable you to log in to the forum) and to help us in managing subscriptions to our newsletters. Neither Cookies that we place on your computer nor IP address records tell us anything about you personally, your visits to other web sites or your other use of the Internet. If you would prefer not to receive any cookies, most browsers can be set to refuse them or to alert you when one is being sent. However, some sections of the Site - and of many other sites that you may visit - will not function properly if cookies are disabled.

Links to Other Sites

The Site contains links to other sites that are not under our control and which have their own privacy policies and terms of use.

Security of Private Information

Unfortunately, no-one can guarantee that the information you provide to them is absolutely safe, as various well-publicised cases of computer security breaches have shown. The most we can say is that we take reasonable steps to protect the information you provide to us from theft, alteration or unauthorized inspection. In addition, in rare instances, we may disclose private information to necessary parties as required by law, to protect our Site or other visitors or to enforce compliance with our Terms of use and disclaimer.

Parents and Children

Parents and guardians should be aware that, if children voluntarily disclose their names, e-mail addresses or other information on forums, reviews, blog comments or via similar facilities, such disclosures may result in unsolicited messages from other parties. We suggest that children are strongly discouraged from providing such information on the Site or elsewhere.
